Sundose x Joy in Me "The Secret of Longevity" COMPETITION RULES
  • 1. General provisions
  1. These Regulations of the Sundose x Joy in Me "The Secret of Longevity" Competition (hereinafter referred to as the "Regulations") define the rules, scope and conditions of participation in the Sundose x Joy in Me "The Secret of Longevity" Competition (hereinafter referred to as the "Competition") organized by Sundose Sp. z o. o. with its registered office in Lublin, ul. Vetterów 1, 20-277 Lublin, e-mail: office@sundose.io entered into the Register of Entrepreneurs of the National Court Register maintained by the District Court Lublin-Wschód in Lublin with its registered office in Świdnik, 6th Commercial Division of the National Court Register under the KRS number: 0000642406, Tax Identification Number (NIP) 712-33-20-705, with the share capital of PLN 395 500.00 (hereinafter referred to as “Sundose”), and JOY IN ME PAULINA NIEDZIELSKA, JAGODA SCHÄPPER SPÓŁKA CYWILNA (address of the place of business and correspondence address: ul. Ogrodowa 48/54, 00-876 Warsaw), Tax Identification Number (NIP) of the civil partnership 5272882838, National Business Registry Number (REGON) of the civil partnership 382567417, e-mail address: contact@joyinme.co, this is
  1. Jagoda Schäpper, entered into the Central Register and Information on Business Activity of the Republic of Poland, run by the minister responsible for economic affairs, with the following identification numbers: NIP 6751280658 and REGON 356872129; and
  2. Paulina Niedzielska entered into the Central Register and Information on Economic Activity of the Republic of Poland kept by the minister responsible for economic affairs, NIP 7123092902 and REGON 061411069.

  1. The Competition Prizes are sponsored by Sundose and Joy in Me
  2. The competition is held in the territory of the Republic of Poland, via Instagram on the profiles @sundose.polska and @joyinme_yoga

  1. Activities related to technical support and selection of winners are carried out by the Organizers.
  2. The competition will run from September 8, 2022, starting with the publication of the competition post on the Instagram profiles: @sundose.polska and @joyinme_yoga, and will last until September 15, 2022, 11:59 p.m.
  3. The Contest is not sponsored, administered, or organized by Instagram. Instagram is not responsible for the Contest.
  4. All questions, comments, and complaints regarding the Contest should be directed to the Organizers, not to Instagram. The Organizers jointly and severally agree to indemnify Instagram against any Contest Participant who files a claim against Instagram related to the Contest.
  5. Advertising materials created for the Competition are for informational purposes only. In the event of any discrepancies between the advertising materials and the Rules, the Rules shall prevail.
  6. The Organizers declare that the Competition is not a game of chance, a raffle, a mutual bet, a promotional lottery, the outcome of which depends on chance, or any other form of game provided for in the Gambling Act of 19 November 2009 (consolidated text: Journal of Laws of 2020, item 2094, as amended).
  • 2. Competition Participants
  1. The Competition is open only to a natural person (hereinafter referred to as the "Participant") who:
  2. a) has a place of residence in the territory of the Republic of Poland,
  3. b) is of legal age,
  4. c) is not in any personal, capital or organizational way linked to the Organizers or the Jury appointed by the Organizers,
  5. d) has read the Regulations and accepts their provisions,
  6. e) has an active Instagram account ,
  7. f) completed the Competition Task correctly.
  8. Failure to meet any of the conditions specified in paragraph 1 point af above constitutes grounds for excluding the Participant from the Competition, and in the event of later discovery of such circumstances, including after the date of awarding the prize, the Organizers have the right to seek its return.
  9. Entry into the Contest is strictly personal. Creating accounts or submitting entries on behalf of third parties, or submitting entries to third parties using your Instagram account , is prohibited .
  10. Each Contest Participant may only add one competition comment.
  11. Each Participant may only enter the Competition once, regardless of the number of Instagram accounts they have.
  • 3. Selection of award winners
  1. In order to ensure the proper organization and course of the Competition, and in particular to assess the correctness of the entries to the Competition and select the winners, the Organizers will appoint the Competition Jury (hereinafter referred to as the "Jury") on the day of the commencement of the Competition.
  2. A Jury of two people, appointed by the Organizers, will be appointed to conduct the Competition. The Jury will consist of a Sundose employee and a Joy in Me employee.
  3. From among the submitted applications, the Jury will select and award 2 people.
  4. In making their decision, the Jury will base their judgment on the comment's accuracy. The number of likes is not taken into account.
  5. The decisions of the Jury are final and not subject to appeal.
  6. The results of the Competition will be published on September 19, 2022. The results will be announced in the comment on the competition post and shared in the Instagram story on the @sundose.polska and @joyinme_yoga profiles by tagging the accounts of the winners.
  • 4. Competition Task and Prizes
  1. To participate in the Competition, the Participant should add a comment under the competition post, containing the answer to the question "What is your secret to "longevity"? And follow the Instagram profiles @sundose.polska & @joyinme_yoga
  2. The prizes in the Competition are:
1st place: Her Daily Longevity or His Daily Longevity product worth PLN 249.00 (in words: two hundred and forty-nine zlotys) gross and a voucher guaranteeing a 100% discount on your next order for Sundose brand products and the FLOW 3mm Dive in and palo santo yoga mat from Joy in Me with a total value of PLN 418.00
2nd place: Her Daily Longevity or His Daily Longevity product worth PLN 249.00 (in words: two hundred and forty-nine zlotys) gross and a voucher guaranteeing a 100% discount on the next order for Sundose brand products and the FLOW Coated 3 mm East West and palo santo yoga mat from Joy in Me with a total value of PLN 418.00

For each prize, the Organizers will award an additional cash prize in the amount of:
1st place: PLN 74.11 (of which Joy in Me will award PLN 46.44 and Sundose will award PLN 27.67)
2nd place: PLN 74.11 (of which Joy in Me will award PLN 46.44 and Sundose will award PLN 27.67)
an appropriate portion of which will be deducted by each Organizer to settle the flat-rate personal income tax on prizes awarded in the Competition (Article 30, Section 1, Item 2 of the Personal Income Tax Act) and transferred to the appropriate Tax Office. Deduction of the 10% flat-rate tax from the value of the prize means that the cash portion of the prize will not be released to the Winner.
  1. The Prize cannot be exchanged for cash or any other prize, and the Winner may not transfer their rights to the Prize to any third party. The Winner may waive their right to the Prize by submitting a relevant declaration to one of the Organizers at: marketing@sundose.io or contact@joyinme.co
  2. The winners will be informed about the details of collecting and redeeming the Prizes referred to in paragraph 2 above by one of the Organizers, who will send a message to their Instagram profile or by e-mail within 14 days of the end of the Competition.
  3. Shipping costs for Prizes are covered entirely by Sundose and Joy in Me. Shipping is available only within the European Union. For shipments outside the European Union, delivery terms will be negotiated individually.
  4. The Organizer is not responsible for the inability to deliver or redeem the Prize due to reasons attributable to the Participant. In such a case, the Prize will be forfeited.
  • 5. Participant's consent
  1. Completing the Competition Task is tantamount to the Participant’s acceptance of the provisions of the Regulations without the need to submit separate declarations in this regard and is tantamount to the Participant’s submission of the following declarations and obligations:
  2. a) The Competition Task constitutes a manifestation of the Participant's individual and original creativity. The text is authored by the Participant or the person from whom the rights to it were acquired;
  3. b) The Participant consents to the publication of his or her name and surname in the event of being awarded the prize referred to in § 4 section 2 of the Regulations.
  4. The participant consents to the dissemination of the content of their comment and submitted idea for purposes related to the Contest and for marketing purposes. Sundose and Joy in Me's use of the Contest Task in accordance with these Rules will not threaten or violate anyone's rights, property, or legally protected secrets.
  5. The Participant accepts that the Contest Task will be used by posting it on social media in connection with the Contest and for marketing purposes. Contest Participants declare that they have exclusive and unlimited property rights and personal copyrights to the Contest Task, and that they have the right to freely dispose of the Contest Task's elements (text) without infringing the rights of any third parties.
  6. If the Contest Task meets the definition of a Work, the License is granted without territorial restrictions for a period of 5 years from the posting of the Contest Task on Instagram for use of the Contest Task in connection with the Contest and marketing activities. After the 5-year period, it becomes a license granted for an indefinite period. The License is granted for the following fields of exploitation:
  7. a) recording and reproducing the work, including by printing, reprographic, magnetic recording, digital recording, recording in computer memory, on other media;
  8. b) trading in the original or copies in which the work was fixed by introducing it into circulation, lending it or renting it;
  9. c) distribution, including public performance, exhibition, reproduction, display, broadcast, rebroadcast;
  10. d) making the Work publicly available in such a way that everyone can have access to it at a place and time of their choice, including the Internet.
The Participant consents to the use of the Contest Task for promotional or advertising purposes and grants royalty-free permission to exercise derivative rights, including the right to create, manage, and use adaptations of the work, along with the right to grant such permissions to third parties, as well as to combine the Work with other Works. Sundose and Joy in Me have the right to grant sublicenses, to which the Participant consents upon submitting the Entry. The Participant agrees not to exercise any of their moral rights in the Contest Task against Sundose and Joy in Me. Sundose and Joy in Me may request the Winner to enter into an appropriate written agreement to transfer all economic rights to the Contest Task.
  1. The Participant authorizes the Organizer to distribute the Competition Tasks anonymously without signing them with the Participant's name and surname.
  2. The Organizer reserves the right to remove and not include in the Competition the following Competition Tasks:
  3. a) inconsistent with the Instagram regulations,
  4. b) not meeting the criteria specified in the Regulations or submitted in violation of its principles,
  5. c) containing content that is inconsistent with good manners, immoral, offensive or violates applicable law;
  6. d) violating the rights, in particular copyrights, or personal rights of third parties, including unlawful use of images of third parties.
  • 6. Processing of personal data
  1. By submitting an entry to the Competition organised by Sundose and Joy in Me, you consent to the processing of your personal data for the purpose of participating in the Competition.
  2. Pursuant to Article 13 paragraphs 1 and 2 of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 (hereinafter referred to as the "GDPR"), Sundose and Joy in Me provide the following information regarding the processing of personal data in connection with the competition:

  1. b) Data Protection Officer:
Sundose, as the Controller, has appointed a Data Protection Officer. You can contact the Data Protection Officer regarding matters concerning data protection, including the exercise of data subject rights. You can contact the Data Protection Officer by email at gdpr@sundose.io or by post at: Sundose Sp. z o. o., ul. Vetterów 1, 20-277 Lublin.
  1. c) Purposes and basis of personal data processing:
The Administrators process your data to enable you to participate in the competition for which you have submitted your entry. The basis for processing is your consent (Article 6(1)(a) of the GDPR).
  1. d) Data recipients:
The Administrator may make your personal data available to its subcontractors (entities whose services it uses for processing) such as:
-IT service providers;
-entities providing accounting services;
-entities providing marketing services;
- entities cooperating in the organization of the competition. Administrators are also authorized to share personal data with other entities if such an obligation arises from legal provisions.
  1. e) The Controllers do not transfer personal data to third countries, except for making data available to the Controllers' subcontractors (entities that process data on their behalf) who provide the Controllers with IT services; the Controllers only use entities belonging to the EU-US Privacy Shield program (Privacy Shield), which ensure compliance of their activities with the GDPR.
  2. f) Data storage period:
Personal data collected in order to enable you to participate in the competition are stored by the Administrators for a maximum period of 10 years from the end of the competition or until the statute of limitations for any claims related to the competition expires.
  1. g) Rights of data subjects:
You have the following rights:
-the right to access personal data and the right to receive a copy thereof;
-the right to rectify personal data;
-the right to delete personal data;
-the right to request restriction of data processing;
-the right to transfer personal data;
-the right to object to the processing of personal data;
-the right to lodge a complaint with the supervisory authority.
Because data processing is based on consent, you also have the right to withdraw your consent to the processing of your personal data at any time. Withdrawal of consent does not affect the lawfulness of processing based on consent before its withdrawal.
In order to exercise the above rights, you may contact the Data Protection Officers.
The Administrator does not make any decisions about you that would be based solely on automated processing, including profiling.
  1. h) Information on the voluntary or mandatory nature of data provision. Providing your data is voluntary, but without providing it you will not be able to participate in the Competition.
  • 7. Procedure for submitting complaints
  1. Any complaints and reservations regarding the course of the Competition may be submitted by Participants in writing or by e-mail to the address of one of the Organizers, indicated in § section 1 of the Regulations, no later than 7 days from the date of the end of the Competition.
  2. The application should include:
  3. a) details of the Participant submitting a complaint or objection, i.e. name, surname, address;
  4. b) possibly the date of the event;
  5. c) description of the complaint/objection;
  6. d) content of the request;
  7. e) description of the circumstances justifying the complaint or request.
  8. The Participant will be informed about the procedure for handling the complaint in the same manner in which the complaint was submitted to the Organizer (unless the Participant requests information to be provided in a different manner), within 7 days from the date of receipt of the complaint by the Organizer.
  9. Any other concerns, questions, comments or complaints regarding the Competition may be sent electronically to the Organizers' addresses: office@sundose.io and contact@joyinme.com
  • 8. Provision of Services by Electronic Means
  1. The Organizers are also service providers of electronic services within the meaning of the Act of 18 July 2002 on the provision of electronic services (consolidated text: Journal of Laws of 2020, item 344, as amended). These regulations also constitute the regulations for the provision of electronic services within the meaning of Art. 8 of the aforementioned Act. The Organizers provide services electronically in accordance with these regulations.
  2. The Organizers provide Participants with a service via the Website consisting in access to the Program application, which enables the Participant to place an order electronically.
  3. In order to cooperate with the IT system used by the Organizers, the Participant must have equipment and a system that meets the following technical requirements:
  4. a) a computer with an Internet browser that supports Cookies and JavaScript technologies;
  5. b) connection to the Internet;
  6. c) properly configured e-mail.
  7. The Organizers reserve that using the services specified in these regulations may involve standard risks associated with using the Internet and recommend that Participants take appropriate steps to minimize these risks. The Organizers ensure the operation of the IT system that enables the use of the service provided electronically in a way that prevents unauthorized access to the content of the communication comprising the service, in particular by using cryptographic techniques appropriate to the characteristics of the service provided, as well as the unambiguous identification of the parties to the service provided electronically. In the event of planned interruptions, upgrades, or other similar events, the Organizers have the right to notify Participants via the email address provided or generally on the website.
  8. The commencement of use of the services covered by these regulations by the Participant is tantamount to concluding a contract for the provision of services by electronic means.
  9. The Participant's consent to use the services covered by these Terms and Conditions may be withdrawn at any time. Termination of the agreement for the provision of electronic services provided under these Terms and Conditions is based on the Participant's request to delete their account.
  10. The provisions of § 7 of these regulations shall apply accordingly to complaints about services provided electronically, with the deadline for filing a complaint being counted from the moment of the occurrence of the event justifying the submission of the complaint.
  11. In matters not regulated in these regulations regarding the provision of services by electronic means, generally applicable provisions of law shall apply, in particular the Act of 18 July 2002 on the provision of services by electronic means.
  • 9. Final provisions

  2. The law applicable to all legal relations arising in connection with the organisation of and participation in the Competition is Polish law.
  3. The Organizers have the right to change the Competition Rules, provided that such changes do not violate the acquired rights of Participants.
  4. In the event of a change or invalidation of any provision of the Regulations by a decision of a competent authority or court, the remaining provisions shall remain in force and shall bind the Organizers and the Participant.
  5. In matters not regulated in the Regulations, the provisions of the Regulations of the Sundose and Joy in Me websites, available at: https://sundose.io/pl/terms/sundose-web-store-rules and https://joyinme.co, shall apply accordingly.
  6. The regulations are effective from September 8, 2022.
